TERMS & CONDITIONS
Domain Names
Any domain names that you wish to use with a site hosted by Amazing Internet need to be transferred to Amazing Internet’s chosen registrar. Ownership of the domain remains unaltered, but Amazing Internet is granted administrative control so that it can ensure that the domain name record is correctly configured for the relevant web and email services.
We will automatically renew all domain names which you have placed in our control unless you specifically request, in writing, that you wish to cancel at least 30 days prior to the expiry date of the domain name. If you do not give written instructions to cancel, and we renew the domain name, but you subsequently decide to cancel, you will be charged for the domain name renewal at our current rate. If you have more than one domain linked to your site, and we control them for you, you will be charged an annual fee at our current rate for all of them (unless a domain name is included in your package such as a Portfolio Series website in which case you will be charged for all but one of them). If you cancel your service part-way through the domain year, we reserve the right to charge the balance of the annual domain fee on all domains that you wish to expire, including the primary domain normally included within a website package, and an administration fee of £25 + VAT for any domains that you require us to release back to you.
Hosting
Any websites that we host for you, and all Portfolio Series and Photostore websites, are hosted on our own servers which are located in a state-of-the-art dedicated hosting facility. While we have an exceptionally good record of service, we cannot guarantee 100% uptime since the very nature of the Internet means that there are points in the International Internet infrastructure that are beyond our control. We currently operate at an uptime percentage of over 99.9%.
Site Content
You are responsible for all updateable content on your website, and any content that you provide to us to display on your site. Amazing Internet Ltd cannot be held responsible for any content that you display, and you warrant that you are the copyright owner of all material that you display on the site, or that you have obtained the necessary permissions to use that material.
We do not wish to censor any material that you display on your site. However, we cannot allow any material of the following types:
- Pornography
- Images which clearly show genitalia
- Anything which is, or could be deemed, illegal
- Anything which infringes another’s copyright or moral rights
- Anything of a lewd or offensive nature
These exceptions are not restricted to images. They include ALL content on the site, including links to sites which contain such excepted material.
Refunds
All of our services are on an agreed fee basis and several products have a free trial available. We therefore expect that when you commit to one of our services you have done so in full knowledge of the service you will be getting and how much you will be paying for it. Although we do our utmost to ensure that we provide you with the system that you require, we do not guarantee that our services will meet your requirements or that they will be free from error. We therefore cannot offer refunds except in very exceptional circumstances where it is clear that we have completely failed to provide the agreed service.
Cancellations
You must give us 30 days written notice of your intent to cancel any service with us. Any payments which fall due within the 30 days notice must still be made. We will assume that you wish your service with us to continue unless you specifically inform us, in writing, that you wish to cancel. This means that we will keep your site on-line until such time as, at our discretion, we decide to cease the service due to non-payment. You are liable for any arrears that are accrued in this fashion. You are responsible for keeping us informed of your current contact details so that we can ensure that our communications are reaching you.
Delivery times
When you commit to one of our services we will give you an estimate of the completion date. For Portfolio and Photostore websites we generally have the site live within 36 hours of receiving your completed checklist and payment. For bespoke/custom work we will agree a schedule of payment and delivery.
Loss of data
Whilst we take great care with the data that you upload to your website and perform daily backups, we are not responsible for any loss or damage to it. Please ensure that you keep your own backups and understand that you use our services at your own risk.
Liability
Amazing Internet Ltd shall not be liable for any direct, indirect, special or consequential damages arising out of your use of or inability to use our products and services.
Indemnification
You agree to indemnify Amazing Internet Ltd. and its subsidiaries, affiliates, employees and related third-parties harmless against any and all damages, penalties, costs, expenses that may occur from your use of our products and services.
Clauses specific to Portfolio Series websites
Domain names
A single UK (.co.uk or .org.uk) or International domain name (.com, .net, .org) is included in the Portfolio package. If your chosen domain name is not one of these types, we can usually include it within the package price, but there are certain exceptions. Some domain names are much more expensive to register and renew, so we reserve the right to charge a supplement to cover this cost. In all cases we will advise you of this cost prior to committing to our service.
Payment
Portfolio Series is a subscription service and we require either a Direct Debit instruction or some other kind of automated payment instruction in place at all times. Where we have such an instruction we will automatically take payment on or around the renewal date.
